TERMS AND CONDITIONS OF HIRE

  1. A booking agreement (‘the hire’) will only be made on these terms and must be in writing (including by email or via the website).
  2. The hire is made between Hillingdon Narrowboat Association (“HNA”} and you the Hirer, that is the person or organisation making the hire.

Payment:

  1. The hire fee is the sum indicated in the booking agreement.
  2. The booking agreement is only made on payment of the hire fee (or a deposit of one third of the hire fee) and on acceptance of these conditions of hire. The total hire fee must be paid not less than one month prior to the commencement of the hire period. Failure to pay the hire fee on time will result in the hire being cancelled.
  3. Cancellation charges. In case of cancellation more than one month before commencement of the hire period one third of the hire fee will be forfeit. In case of cancellation less than one month before commencement of the hire period the full hire fee will be forfeit.
  4. A damage deposit may be required and must be paid before the commencement of the trip. It will be repaid less any appropriate deduction following the hire period.

HNA’s Responsibilities:

  1. Except in relation to the ‘self steer’ boat, HNA will provide a skipper, who will be responsible for the safety and use, and is in charge, of the boat at all times.
  2. The skipper is entitled to terminate the hire if in the skipper’s sole opinion circumstances so indicate.
  3. HNA will use reasonable endeavours to enable the boat to follow any route which may be indicated to the Hirer, whether before or after the booking agreement is made, but no responsibility can be taken for a failure to do so, whether as the result of breakdowns, stoppages, illness or whatever cause, and no responsibility can be taken for a failure to honour the booking agreement at all for reasons beyond HNA’s control.

Your – The Hirer’s – Responsibilities

  1. You must provide at least 2 adults as part of your group who will be responsible for the group and who must maintain good order and reasonable discipline among the group throughout the hire period. You will be responsible for the behaviour, actions and defaults of the whole group and its members.
  2. The total number in your group must not exceed 12 persons at any time.
  3. No dogs or other animals may be brought onto the boat by your group except by prior arrangement.
  4. All members of your group must at all times obey any lawful instructions which may be given by the skipper in connection with any matter concerned with the navigation and use of the boat.
  5. You must keep the boat and its contents in good repair and condition, and must keep and leave it in a neat, tidy and clean condition and remove all your group’s belongings and all rubbish at the end of the hire period.
  6. You must pay for all damage or repairs or replacement of crockery and other articles or fittings or other parts of the boat broken or damaged by your group and all cleaning costs and bills necessary to put the boat and its contents into the same condition as when the hire period started.
  7. No smoking or vaping is allowed at any time inside the boat.
  8. You must provide bedding, including pillows, pillowcases and towels where required on overnight trips.
  9. Where appropriate (such as for scouts, care homes and local authorities) you must ensure that you have adequate insurance cover for your group for the hire period to cover the risk of personal injury or loss or damage to personal belongings and any consequential loss. You may wish to insure against cancellation.
  10. Where appropriate (such as for scouts, care homes and local authorities) you must provide suitable first aiders and carry out your own risk assessments in advance of the hire and must report any risk areas particular to your group to the skipper before boarding the boat.
  11. Any activities off the boat are the sole responsibility of the hirer and it is for the hirer to risk assess any such activities, whether or not suggested or identified by the skipper or HNA.

Privacy and personal data

  1. HNA will hold your booking information for 5 years, for use in statistics, marketing and legal purposes. If you wish to be removed from the HNA database, please inform HNA. The handling and collection of any personal customer data is processed in accordance with local law and is not sold to third parties.
